When I talk to MBA students about sales as a career, a distasteful look fleets across their faces. For may getting into sales after doing an MBA from a top MBA college is unthinkable. I sympathize. The image of a sales person conning you into buying something you do not need comes to mind. I did hardcore sales for 2 years and then decided never to do it again. Lo and behold, for the last 10 odd years I have been spending an increasing proportion of my time selling. As I grow more senior in an organization, I am selling my organization’s products to customers, the organization’s prospects to shareholders and the organization’s values to current and prospective employees.


The reason selling seems distasteful is probably because I am dependent on the ‘buyer’ to make a decision and therefore I am in his power. Maybe this hurts my ego. Another reason could be that there is no set formula for success and we need to make a new effort and come up with a new tactic for each sale. This means we need to understand and adapt to each situation as it comes. There is no predictability and so a perceived loss of control.


Is convincing people not selling? Am I not spending my day in and outside office convincing and being convinced? How can I escape selling?


So let us get real. We sell all our life and sales is unpredictable. There is statistically a 50 percent chance of success or failure. If our success rate more that 50%, we are ahead of the curve.


Although there is no formula, I have adapted the old Xerox methodology for selling. This was called the SPANCO method.


Suspect – list of all potential customers that I need to convince

Approach – what tactics do i adopt for each customer


Negotiate – Come to terms, monetary and otherwise


Close – get a letter of intent or be the only one in the running


Order – get the money or a contract


In order to sell anything, including myself for a job, I can follow this method.


S: I make a list of all potential companies that I can apply to.


P: I create a set of criteria to short list the targets. This can be based on location, salary, other perks, culture, learning potential, availability of jobs, seniors’ feedback, competition with other job seekers, company financials, company potential etc. I give weight to each of these criteria in order of importance. I then do my research and give points for each criteria (simple one is: 1 for favourable, 0 for no information, -1 for unfavourable). I then perform a weighted average calculation for each suspect and come up with a short list of companies.


A: For each company, I find out who to contact, what is the job, how to meet the person, what makes that person tick (what is in it for him), why will they take me, where and when should I meet the person, in essence the who/ what/ where/ why/ when/ how of each prospect. I need to have a 3-line pitch ready. This is when I customize my resume based on the requirement (equivalent to a proposal).


I do the homework and then I approach the company. Once I have reached a decision maker I make my short pitch and get him to engage so that there is a follow up action. I cannot get a sale done in one meeting and this stage takes time, with different meetings, different deliverables and maybe different approaches.


N: Once the prospect is convinced about the product (me), he needs to get the company to shell out money (salary). So a negotiation starts with maybe the purchase department (HR in this case). This is the time when I need to evaluate the relative merits and demerits of the competition, so I need to know who is the competition and I project myself as the ideal product for the job in the most cost effective way.


C: This stage is when I am the only candidate in the running and the numbers have been negotiated. This is where I am waiting for an appointment letter. Many times, specially like now, these letters can be withdrawn or a renegotiation can happen.


O: This is when I have actually joined or I have a proper contract with the company, the PF has been set up and I am a bona fide employee.

The foundation of Arbitration lies in the supremacy of parties to decide the Arbitration procedure, appointment of Arbitrators, qualifications of Arbitrators, Place of Arbitration etc., In a litigation parties cannot choose either the judge or his experience or his qualification but in an arbitration parties are empowered to choose the type of Arbitrator they require in advance while entering an arbitration agreement. Hence the Major difference between a Court litigation and an arbitration is the power of the parties to decide its arbitrators. 


 


Hence, globally in case of a sole arbitrator, he is jointly chosen by parties or appointed by a neutral institution or court is in practice. In case of a tribunal, each party gets an opportunity to nominate one arbitrator each and both the arbitrators jointly appoint the chairman of the tribunal. Such an arrangement gives parties confidence on the panel that is going to decide the disputes between them. The above said systems are followed every where but still many parties do not have the required level of confidence on the arbitral tribunal since in many cases their right to appoint their nominee either get diluted or restricted in such a way that the party gets frustrated and become non-co-operative, right from the beginning.


 


In India, the courts have consistently upheld the conferred right of a party to appoint a Sole arbitrator in its own case. While examining such Arbitration agreements, Courts decide keeping in mind the interest of the Public-Sector Undertakings and Governments and uphold such agreements. 2015 Arbitration and conciliation (Amendment) Act brought in a lot of changes to ensure real transparency and to curtail arbitrators who ignore their conflict of interest in the matter and decide the matter. The said amendment was excessively progressive and incorporated the IBA guidelines on conflict of interest in commercial arbitration into the Act. The said Amendment imposed a mandatory duty on each arbitrator to keep on declaring their availability and conflict of interest throughout the proceedings till the completion.      


 


The above said Amendment generated a lot of enthusiasm among the arbitration community, when it brought in S.12(5) and Schedules V, VII & VII since they promised a promising future for arbitration in this country. The Said schedules prohibited certain category of persons from getting considered to be an arbitrator because of their relationship with either of the parties or the counsels. The said mandate brought under section 12(5) required the arbitrator to declare and disclose any relationship with the parties and the counsels appearing for parties. Schedule V, is a list of relationships describing justifiable doubts for arbitrators for making the declaring under the format provided under Schedule VI. Moreover, the relationship mentioned in schedule V does not disqualify the arbitrator from getting appointed.  But if an arbitrator is covered under any of the relationships mentioned in Schedule VII, then he is disqualified to be appointed as the arbitrator in a particular case. If any person falls under any of the relationships mentioned in Schedule VII then parties may approach the respective High Court under S.14 of the Act and pray for removal of that arbitrator. If any body falls under the category of Schedule V, then the party having justifiable doubts about the impartiality and independence of the arbitrator shall file an application under S.13 before the arbitral tribunal challenging the continuance as arbitrator. If the said arbitrator after hearing the application recuse himself after the application, then a new arbitrator shall be appointed following the procedure provided in the Act. But if the said application is rejected then the aggrieved party will have the liberty to raise bias as an additional ground while challenging the award under S.34 of the Act. 


 


But, unfortunately Parties are still finding ways to overcome those provisions by looking for committed Arbitrators. Arbitration agreements empowering one party to appoint the sole arbitrator is increasing. After DMRC Judgment of Supreme Court all PSUs and Government Departments are preparing the so called broad based panel to restrict the choice of the opposite party, to choose their nominee. Even after such efforts by PSUs appointing persons who are indirectly connected to them, the awards given against PSUs and Government are increasing in a big way. If the panels are prepared based on their domain knowledge and exposure, that may end up in good results. It is also important to note that high value arbitration awards are passed so casually without understanding even the basics of a sustainable award. Arbitration community of our country should realize that time has come that we should look for professional and competent arbitrators, who can deliver fair and sustainable awards.

Year-end planning helps define your ‘what’. To be inspired in your aspirations, here’s a tool to help define your ‘how’.


It’s coming up to a new calendar year. A great time for planning.


When you plan for your upcoming year, you can be ably guided by your Impact Purpose. That defining statement that summarizes the impact you want to have with your business. I’ve covered the process for clarifying your Impact Purpose in other articles, so I won’t focus on that here.


With your Impact Purpose, it clarifies the ‘what’, but not the ‘how’.


Here’s a simple and powerful tool you can use to guide your ‘how’ in the coming year.


You may have heard of the ‘word of the year’. It’s an aspirational word that encompasses the feeling of how you want to move into and through the year. It captures an elegant idea, the essence of something significant for you. It becomes the catalyst for a deep shift in your way of being.


A meaningful word that really engages your power is about both you and others, how you treat yourself and others, including your clients, your employees, and your suppliers. A meaningful word helps you delineate the ‘how’ of your everyday actions.


In my own past, I’ve used words like, ‘courage’, ‘abundance’, and ‘connect’. To help remind me, I’ve printed the words on index cards and even had a bracelet made one year.


These words have proven to be a powerful guide when I am in the weeds and forget who I am and what I want to achieve. So why not just choose a word of the year for 2019?


Because I’ve changed. I no longer plan my year on an annual basis. I’ve found that annual planning is not nearly as effective as planning for 12 week periods. In those 12 weeks, I can maintain high energy. I can stay highly motivated. I can get a TON done. And at the end, I can celebrate my accomplishments.


With a longer time frame, like a year or more, all of those things fade. The year’s end seems far away, with lots of time to get things done.


Truth? The year’s end will sneak up on you, and you may find that you didn’t accomplish nearly as much as you’d planned.


Using the 12 week time frame has been a powerful shift in planning for me. And I needed an aspirational ‘how’ to match it.


So in this coming year, I’ll be choosing a word of the quarter instead. A word that summarizes the feeling of how I want to move through my 12 weeks.


We all need inspiration for our aspirations.


You can be inspired by adopting this practice yourself, and really kick up serious and impactful change in your first quarter of 2019.
